AN ACT TO AUTHORIZE THE DEPARTMENT OF AGRICULTURE AND COMMERCE TO SELL, OR GRANT A LEASE ON, CERTAIN REAL PROPERTY OWNED BY THE DEPARTMENT AND LOCATED IN THE CITY OF JACKSON, HINDS COUNTY, MISSISSIPPI, ON INTERSTATE 55 NORTH/FRONTAGE ROAD; AND FOR RELATED PURPOSES.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

SECTION 1. (1) Upon meeting the requirements of Section 29-1-1, the Department of Agriculture and Commerce, acting through the Department of Finance and Administration, is authorized to sell, or grant a lease on, certain real property owned by the Department of Agriculture and Commerce and located in the City of Jackson, Hinds County, Mississippi. Such property adjoins the Tullos Chiropractic Family and Sports Rehabilitation Clinic at 3710 Interstate 55 North/Frontage Road and runs South from the clinic's parking lot.

(2) The real property described in subsection (1) of this section shall not exceed one-third (1/3) acre; and the term of any lease of the property shall not exceed twenty (20) years.

(3) If the real property described in subsection (1) is sold, then the consideration for the property shall not be less than the current fair market price as determined by two (2) certified general appraisers selected by the Department of Finance and Administration.

(4) The State of Mississippi shall retain all mineral rights to the real property sold or leased pursuant to this act.

(5) The proceeds from the sale or lease of the real property described in subsection (1) shall be deposited into the Department of Agriculture Special Fund.

SECTION 2. This act shall take effect and be in force from and after July 1, 1999.
